Under Section 3 of the West Pakistan Family Courts Act 1964 and established Islamic legal precedents, any child proved to be the biological offspring of the deceased holds full lineage rights (*Nasab*).
Male and female offspring receive their Quranic shares directly from the residual estate. A son receives twice the share of a daughter, taking precedence over distant collateral relatives such as brothers or nephews of the deceased. If the primary family disputes the paternity of children from a secret marriage, courts order scientific verification, including DNA testing under the Qanun-e-Shahadat Order 1984.
In practice, the legal resolution process begins when the secondary family files an objection to the primary family’s succession petition. Once the civil judge or NADRA identifies competing claims, the succession process freezes until a competent family court decides the validity of the marriage and paternity. Upon judicial confirmation, the court recalculates all shares, redistributing the estate among the surviving parents, all verified wives, and all children according to statutory legal ratios.
